If an accountant acts as agent for their client in obtaining legal advice from a lawyer, discussions between the accountant and their client that were for the purpose of obtaining or providing legal advice should be subject to solicitor-client privilege.

For Accountants

The accounting and legal professions each play a unique and complementary role in resolving tax disputes.  That is why we designed the Canadian Tax Audit Protection Plan to complement, not compete, with your services. In fact, it's our preference that you continue to act as our primary contct in advising and assisting your clients who become members.

By becoming a Participating Tax Professional, you will be able to:

  • Obtain advice and assistance from qualified and experienced tax lawyers to assist you in advising your clients
  • Provide your clients with access to legal counsel at a reasonable cost in the event that they are audited and reassessed by the CRA;
  • Extend solicitor-client privilege to communications between you and your client in respect of an audit or reassessment; and
  • Reduce the cost-barrier for your clients to appeal a tax reassessment to the Tax Court of Canada.
You and your client will also have the Peace of Mind of knowing that in the event of an audit, you will have access to the knowledge, experience, and assistance of the lawyers and staff of Sixth Sphere Services Professional Corporation to assist you and ensure that your client's legal rights are protected.

There is no charge to you to become a Participating Tax Professional.  However, in keeping with our belief that both the accounting and legal professional each play a role in resolving tax disputes, we ask that you undertake to:

  • Assist your clients and others in becoming Members of the Plan by processing their membership application through our secure website,
  • Assist Members who may require legal assistance under the Plan in obtaining that assistance, and
  • Assist Members who are under audit in providing documents and information to us for the purpose of providing legal advice to the Member.

In exchange, you will receive a fee equal to up to 15 per cent of Membership Fees of your Member clients.  Please see our Participating Tax Professional / Firm Agreement for complete details.
